Ban on disembarking on the islands of Giglio and Giannutri with motor vehicles (2024 decree)

In the municipality of Isola del Giglio there is a ban on disembarkation by vehicle for non-residents during the tourist season: on the island of Giglio only in August, while on the island of Giannutri from the end of March to November.


Like every year, during the tourist season, non-residents are prohibited from taking the ferry to the islands of Giglio and Giannutri with a motor vehicle in tow, due to the entry into force of the disembarkation ban.

On the Island of Giglio, the influx and circulation of both vehicles of people who are not permanently resident on the island (generally from the beginning to the end of August) and buses of non-island companies (generally from April to September) are prohibited.

On the Island of Giannutri (generally from Easter to November) the influx and circulation of vehicles of people not permanently resident on the island is prohibited.

Let’s see the ministerial decree in detail below, with the prohibitions, the precise dates in which it comes into force year by year, the exceptions and the sanctions.

Limitation on the influx of motor vehicles for the year 2024 on the islands of Giglio and Giannutri

The Minister of Infrastructure and Transport, having seen article 8 of the legislative decree of 30 April 1992, n. 285, concerning limitations on influx and road circulation in small islands where declared municipalities of residence or care are located; considering that, pursuant to the aforementioned article, the Minister of Infrastructure and Transport, after having consulted the regions and municipalities concerned, has the power to prohibit, during the months of most intense tourist movement, the influx and circulation in the small islands of vehicles belonging to people who are not part of the stable population; having seen the resolution of the municipal council of the Municipality of Isola del Giglio of 22 January 2024, n. 11, concerning the ban on entry and circulation in the Islands of Giglio and Giannutri for vehicles belonging to people who are not part of the population permanently resident in the same islands and for buses belonging to companies not having their registered and administrative headquarters on the Island of Lily; having seen the note from the Territorial Office of the Government of Grosseto –
Area III – dated 27 February 2024, n. 11077, with which a favorable opinion is expressed for the issuing of the decree in question; having seen the resolution of the Tuscan Regional Council of 29 January 2024, n. 67, with which the Tuscany Region expresses a favorable opinion on the issuance of the decree in question and the subsequent note of correction acquired with protocol. n. 5585 of 22 February 2024; deemed appropriate to adopt the requested measure restricting road traffic for the reasons expressed in the aforementioned documents;

decrees the following.


Prohibitions

From 1 April 2024 to 30 September 2024, the influx and circulation on Giglio Island of buses belonging to companies that do not have their registered and administrative headquarters on the island itself, with the exception of the concessionaire that provides local municipal public transport.

From 5 August 2024 to 25 August 2024, the influx and circulation on the Giglio Island of vehicles belonging to persons not permanently resident on the island itself is also prohibited, including, in the prohibition, the vehicles of persons residing or domiciled in Municipality of Isola del Giglio.

From 29 March 2024 to 1 November 2024, the influx and circulation on the Island of Giannutri of vehicles belonging to persons not permanently resident on the island itself is prohibited, including, in the prohibition, the vehicles of persons residing or domiciled in the Municipality of Giglio Island – fraction of Giannutri Island.


Exceptions

For the Island of Giglio, in the period referred to in art. 1, paragraph 2, the following vehicles are excluded from the ban:
a) vehicles belonging to non-residents registered in the municipal waste collection tax rolls who self-certify this condition pursuant to the decree of the President of the Republic of 28 December 2000, n. 445, and subsequent amendments;
b) vehicles whose owners, non-residents, will spend at least five days on the island and caravans and motor homes whose owners will spend at least four days with their vehicle in the only existing campsite on the island. During the period of validity of the bans, the owners will have to show, upon disembarking on the island and at the request of the control bodies, a self-certification, to be kept inside the vehicle for the entire period of stay, in which the vehicle data (number plate and owner), the declarant’s data (personal data, address and tax code) and the accommodation provider’s data (business name, location and period of stay), as well as the arrival and departure dates;
c) vehicles with foreign license plates;
d) vehicles for the transport of goods, provided that they do not conflict with the traffic restrictions in force on the roads of Giglio Island;
e) ambulances, hearses, police and fire service vehicles;
f) vehicles serving people with disabilities, provided they are equipped with the appropriate mark required by art. 381 of the decree of the President of the Republic 16 December 1992, n. 495, and subsequent amendments and additions, issued by a competent Italian or foreign authority.

For the Island of Giannutri, in the period referred to in art. 1, paragraph 3, the following vehicles are excluded from the ban:
a) ambulances, hearses, police and fire service vehicles;
b) vehicles serving people with disabilities, provided they are equipped with the appropriate mark required by art. 381 of the decree of the President of the Republic 16 December 1992, n. 495, and subsequent amendments and additions, issued by a competent Italian or foreign authority;
c) vehicles used for the recovery of MSW and for the transport of materials classified as special waste;
d) vehicles used for water supply, maintenance of the aqueduct, sewerage network and electricity network, for the transport of diesel fuel for power plants, as well as commercial vehicles, limited to one working day.


Permissions

The Municipality of Isola del Giglio is granted the right, in case of proven and real need and urgency, to grant further authorizations in derogation of the disembarkation ban.


Sanctions

Anyone who violates the prohibitions set out in this decree is punished with the administrative sanction of paying a sum ranging from 430 euros to 1,731 euros, as provided for in the art. 8, paragraph 2, of the legislative decree of 30 April 1992, n. 285, with the updates referred to in the decree of the Minister of Justice dated 31 December 2020.


Supervision

The Prefect of Grosseto is responsible for the execution and systematic and assiduous supervision of compliance with the prohibitions established with this decree, for the entire period considered.
